About New York Amusement Park Accidents

Amusement ride fatalities are relatively rare, although they do happen even on seemingly safe children’s rides. For example, a six-year-old boy was killed in March 2011 when a speeding children’s train overturned in a South Carolina park.

Much more common are serious non-fatal injuries, such as traumatic brain injuries, broken bones, broken noses, whiplash, hemorrhages, finger and other body part amputations, concussions and paralysis.

A report from the National Safety Council shows that more than half of the injuries on fixed amusement rides (those permanently located at parks as opposed to ones that are moved to various locations at fairs and carnivals) happen on rides designed for adults. About a third of all fixed ride injuries occur on roller coasters, according to the report.

In effort to keep preventable amusement ride accidents from happening, both New York State law and the New York City Department of Buildings set regulations for all rides — both fixed and mobile. They require annual inspections in addition to initial testing and inspection when a ride is first erected.

Regulations also require ride operators to be at least 16 years old or 18 years old, depending on the ride type. They must also be knowledgeable about the ride’s controls, including its safety and emergency equipment.

Rides cannot be overloaded with too many patrons, and they cannot operate in bad weather conditions, such as high winds, according to the regulations. If a serious accident happens, the ride must be shut down until the cause is determined.

To provide coverage when a negligently operated or maintained ride hurts someone, New York law requires rider operators to carry insurance with limits of $1 million per occurrence and total aggregate coverage of $2.5 million.
